Vendor Terms of Service
These Vendor Terms of Service (“Terms”) govern how businesses (“Vendors”) use the Affordable Options Kamukunji platform (“the Platform”). By registering as a Vendor, you agree to these Terms. Please read them carefully.
1. Vendor Eligibility
To qualify as a Vendor on Affordable Options Kamukunji, the following requirements must be met:
The business must be legally registered in Kenya.
The business must have a verifiable physical location for operations, pickups, or returns.
Vendors must provide accurate business information and update it when changes occur.
2. Commission & Service Charges
Affordable Options Kamukunji will deduct 10% from the selling price of each completed order as commission. This 10% covers:
5% – Business Hosting & Platform Maintenance
2% – Delivery Subsidy
3% – Service Fee
2.1 Vetting for Subscription Eligibility
After 6 months or more on the Platform:
Vendors will be vetted to determine eligibility for a Monthly Subscription Plan (optional).
Vendors who subscribe will enjoy enhanced features (detailed in Section 4).
3. Vendor Access to Customer Information
To maintain customer privacy and prevent misuse:
3.1 Before 6 Months (Standard Vendors)
Vendors can only view:
Product ordered
Order number
Customer name
Vendors cannot see:
Customer phone number
Customer email
Customer address
3.2 After 6 Months + With Monthly Subscription
Eligible Vendors who subscribe to the monthly plan will have access to full customer details, including:
Phone number
Email
Delivery address
This access is only granted while the subscription is active.
4. Monthly Subscription Benefits
Vendors who opt for the Monthly Subscription will be charged a revised service fee of 5% of the selling price (instead of the standard 10%).
Benefits include:
Access to full customer details
Priority product listing
Dedicated support
Reduced service fee
Faster review & approval of product listings
5. Vendor Payment Schedule
Vendor payouts will be made based on daily sales thresholds:
Vendors with sales below KES 20,000 will receive payouts in the evening.
Vendors with sales above KES 20,000 may request payouts immediately on demand.
All payments will be made through the payment methods supported by the Platform.
6. Delivery & Rider Options
Vendors may choose to use their own riders for deliveries if they wish.
Vendors must ensure their riders follow platform delivery guidelines and customer service standards.
If using the Platform's logistics partners, the Vendor agrees to the associated delivery timelines and charges.
7. Product Posting & Approval
All product listings undergo internal review to ensure quality, compliance, and accuracy.
Affordable Options Kamukunji reserves the right to approve, reject, or request revisions to listings.
Vendors who demonstrate consistent reliability and compliance may be granted bypass privileges, allowing them to post products without mandatory review.
8. Wrong Products, Returns & Warranty Responsibilities
8.1 Wrong, Faulty or Misrepresented Products
If a Vendor dispatches:
Wrong products
Wrong color
Faulty items
Products not matching the listing description
…the Vendor will be fully liable for:
Return delivery expenses
Replacement or refund costs
Any additional logistics required to correct the order
8.2 Warranty Items
Vendors must honor all warranties they advertise.
The Vendor is responsible for handling warranty claims, repairs, replacements, or refunds.
8.3 Products Damaged on Delivery
Affordable Options Kamukunji is not liable for:
Broken items
Faulty products
Any defect found by the customer upon receiving the goods
Unless exceptional circumstances apply, and such cases will be reviewed individually.
9. Vendor Return Policies
Each Vendor must clearly state their own return and exchange policy, which should be:
User-friendly
Transparent
Compliant with Kenyan consumer protection laws
Inclusive of returns for faulty or wrongly-delivered products within the timeframe the Vendor specifies
Affordable Options Kamukunji reserves the right to reject vendors whose terms are deemed unfair or abusive.
10. Vendor Conduct & Obligations
Vendors agree to:
Provide accurate product descriptions and prices
Maintain product quality and availability
Deliver orders promptly
Treat customers and support staff respectfully
Not engage in fraudulent, deceptive, or unethical behavior
Violation of these obligations may result in account suspension or termination.
11. Platform Rights
Affordable Options Kamukunji reserves the right to:
Suspend or terminate Vendor accounts
Adjust commission rates or subscription fees with prior notice
Remove listings that violate guidelines
Update or modify these Terms at any time
Vendors will be notified of significant changes.
12. Limitation of Liability
Affordable Options Kamukunji is not responsible for:
Losses caused by Vendor negligence
Damaged products
Delays caused by Vendor riders or third-party riders
Business losses resulting from Vendor actions or technical issues outside platform control
13. Termination
Either party may terminate the vendor relationship.
Upon termination:
Outstanding commissions must be cleared
Pending orders must be fulfilled or refunded
Access to customer data is immediately revoked
14. Governing Law
These Terms are governed by the laws of Kenya.
Any disputes shall be resolved through negotiation, and if unresolved, through the appropriate Kenyan legal channels.
15. Additional Provisions
Vendors must keep their login credentials secure.
Multiple accounts for the same business require approval.
Vendors may be required to submit updated business documents periodically.
Vendors authorise Affordable Options Kamukunji to use product images for marketing unless they opt out.
